hour. >> greta: did you hear the examine -- exchange between karl rove and sean hannity about this upset in delaware? that's the candidate that governor sarah palin endorsed is that right? >> yes. there are a lot of republicans who are very concerned about the race in delaware tonight. yes, you are right. sarah palin backed christine o'donnell so did south carolina senator jim demint. she had the backing of the tea party express they spent $250,000 on that race against mike castle the congressman who voted for cap and trade among other votes that many people, conservatives were upset about. the tea party express says, look at the race in nevada, where sharron angle is according to some polls up by a point or two, or down by a point or two, she was written off when she won the race in nevada in that gop's senate primary back there. they say they hope that christine o'donnell could do the same. you listen to people like karl

rove, they have serious doubts. >> greta: brett, that you. more political news any minute, bret will be back as soon as more news breaks. we are live in florida. hours ago in a pensacola, florida federal courthouse the showdown began. 20 states taking on the feds over the health care law. "on the record" was in the courtroom and we have the inside story. we are outside the federal core house where they just had a hearing on a motion to dismiss brought by the federal government to dismiss the lawsuit brought by the states of the four gentlemen here with me utah, florida, alabama and representative from louisiana. let's start with the home state, florida. how did you do? >> i think we did well. the judge particularly on the florida and state's case with regard to medicaid and over power nature made comments like it is a catch 22 for the states the states are powerless, stuck with it. those things tend to lead me to believe that he's listening to our side.

i think we have the better end of the argument on the individual mandate. listening to what he said about the way he perceived this. i think he's going to rule in our favor. much of this today was stage play. it was stage play by the attorneys because we are arguing the case further down the road too on the motion for summary stkwhrauplt is going to come up december 16th, which was a wig o'big today. he said ing i rule against the justice department and for the states in this case, and we have -- we go forward we are going to have a jump judgment series of motions and hear those on december 16th. that's a very fast track. >> greta: lawyers come out of the courthouse and say what a great day they had. never come out and say it is a terrible day. to you now in terms of today, what made you worried? you can't come out totally confident. >> i'm pretty confident there. was discussion about standing and whether states had passed

a law like virginia did that prohibited citizens or states from being required to pay for insurance. there was some discussion about whether any had done that prior to this lawsuit being filed? utah did file it. the judge said it only takes one so maybe it will be utah. most extraordinary today the surprising thing that happened from the government, as you know, this 2700 pages it talks about commerce clause, commerce clause, authority. the judge pointed out that's not what they -- they were saying it is not a tax. she said even the president said this is not a tax. then, the government's attorney says yeah but, it is a tax. >> greta: explain why it makes a difference whether it is called a tax or penalty? lawyers get hung up on words -- ash what is the legal difference in this case? >> what we are talk about is states' rights, 10th amendment versus federal government. this is not in their

enumerated power to tax individuals or require to you buy individual insurance. >> greta: the feds do not have? >> do not have that authority. so they have to look somewhere elsewhere. they realize the commerce clause is not going to fly this is not interstate commerce. now they are arguing it is our broader taxing power that's what you heard today. i think the judge saw it as disingenuous. clearly that's what they said and they are going to be held to what they intended when they passed the act. >> greta: is interesting, when the statute was passed, no one wanted to call it a tax because no one wanted to be in the position of imposing or raising taxes. the house, the senate didn't call it a tax, the president didn't call it a tax. now the government is in an awkward position saying it is a tax within our powers. so politics does play a little of course it does. what i saw today never has so much history been so greatly

rewritten in such a short amount of time. they are trying to erase what happen. we are here today to do what should have happened in congress' house. they should have protected the constitution. the voices of the american people weren't heard in congress. the voices of the founding fathers were silenced. we come here today to listen to those voices. we come to say that contrary to what alcee hastings said the night before they vetted when he was asked what do you think about the republicans' efforts to stop this vote? he said they won't succeed. they about the procedural rules? he said there are no rules tomorrow. there might not have been rules the day it passed but there are rules today and the rules are what we are here to kate and they are found in the constitution this is a -- here to vindicate and they are found in the constitution. >> greta: there was a lot of discussion in the state of louisiana the idea that the federal government can regulate interstate commerce. something -- an activity that

has substantial impact on interstate commerce. now the big question whether it is an activity or not? what was that discussion about? >> greta, first of all, the attorney general of louisiana sends his regards. one of our lawyers couldn't have put it better. he said there's a lot at stake in this courtroom. the future of health care in this nation. unprecedented intrusion on the sovereignty of state and right of citizens. the question can average citizens or citizens below average income be forced, 0 cursed to buying health care penalized or taxed in an illegal manner. >> greta: the federal government has the ability to intervene if it is interstate commerce. so the question is, whether or not this statute is interstate commerce? a broad definition, lose. narrow definition of interstate commerce of what the government can do, you win.

and the question that the judge was focusing on is whether or not requiring someone to buy insurance, this machine dated economic activity or not? >> greta, louisiana courtrooms i try not to guess at judges until they rule. at the end you heard him say on one count he's going to deny their motion to dismiss that means -- or he predicted he that means this suit is going forward. our lawyers did a great job. on the commerce clause, i think we are going to win. i think we are going to win on the other issues. i think the american people are behind us on these issues and one of the attorney generals said we are doing what congress should have done. >> one comment. this is going to the u.s. supreme court probably going to be a 5-4 decision. they will say the commerce clause applies. five are going our way. i'm going to predict that

right now this is the greatest intrusion by the federal government in the commerce laws ever in history that's why they are bailing out like attorney general strickland said and trying to go on the tax issue. we went on that too, there's nothing in the law that allows them to do this. nothing in the constitution that allows the kind of tax they are proposing. they are weak on this, we are going to win. >> greta: alabama, what is your reaction? >> folks in alabama are like folks across the country. they feel disinfranchised, they feel like their rights were trampled. they weren't buying votes with their own money they were using our known buy votes for things we don't want. whether it was ben nelson's deal the deal over in louisiana, in alabama, i think we long for the good old days when legislation passed and fail in the congress based on whether it was good or bad public policy not whether you can find enough money to buy enough votes to get your way. outrageous what has happened.

shocking upset beating castle in the republican primary for the u.s. senate former senator joe biden's seat. joining us rick klein senior washington editor of abc "world news tonight." doesn't get much wilder than this, does it? >> this is the upset of the year. this is not just about the energy in the primaries. this is going to have real implications in the fall. nobody saw this coming until a couple weeks ago. castle did everything he could. we see tea party energy in one of the most democratic states in the nation. a guy who has been on the political scene in delaware for three decades is a stunner, huge development. >> greta: the dnc was quick tim kaine said -- called her self-aggrandizing and divisive candidate, extreme views. the tea party express congratulated her. they said they added, this is a tea party express wake up corrupt politicians in

we saw ads from republicans talking about her personal finances, various issues. she was in the right place at the right time to run on this message is what voters wanted to hear in a year like this. she the support of sarah palin, senator demint late. the vessel for hopes and frustration that delaware republicans have had with mike castle, a moderate republican in that state for sometime. >> greta: i was list thing to sean hannity and karl rove talk about her. they went at each other debating of course, about it. karl i think is fair to say is very suspicious of her as a candidate and sean supports her this is going to divide a lot of conservatives. >> that's right republicans thought the only way to win in delaware was to have a moderate someone like mike castle run statewide as governor, state's only member of the house they that -- they thought he would win. to have a tea party favorite like o'donnell win this

nomination big blow to their chances. there's something that the national republicans are going to be split on. a lot are going to say we are going to focus elsewhere if she can pull it off great they are not going to spend a lot of time and attention nationally to butte her can -- to boost her candidacy. >> greta: even her 2008 senate campaign chair made robo calls against her saying she is no conservative and all she wanted to do was make a buck. she said the former campaign chair was incompetent this one is ugly. >> that's right a lot has been dumped in the republican primary. the republican party in delaware has been dedicating resources to knock her candidacy off. they were fearing this. they wanted mike castle to win. he has had a long and storied career said to watch him concede victory in his own

party primary tonight. >> greta: scott brown took senator kennedy's seat after president obama campaigned there. then you've got this battle right now over vice president biden's former senate seat and then senator obama's seat in illinois up for grabs. is there some sort of message on the wall or is that us having fun with politics? >> we love those three seats because they are the crown jewels of the election cycle. for republicans to win it sends a psychological message. this tonight is about the numbers. republicans see their chances diminished in delaware already independent analysts are downgrading republican chances in the state. koontz is one of the happier delegates out there. >> greta: rick, that you. >> next, a man who can't be popular with president obama tonight and what makes it more complicated is that he is a

shocking up set in delaware the republican primary not the only stunner. bret baier joins us live with the latest. >> bret: breaking news as o'donnell is accepting this victory in delaware, carl cameron is reporting from sources at the national republican senator campaign committee that the nrsc will not, will not, support christine o'donnell in delaware in her general election campaign against chris koontz the democrat in november. these sources telling carl that tea party activists promise if o'donnell won the primary she could win in november as well. they are telling us, telling fox that they will not support o'donnell. as you take a live look at her right now. instead, leave it to others, namely the tea party, saying of course according to carl, these sources have told him, the money is better spent in other places. there you see, the evidence of the big rift between the establishment republican party and this particular candidate

who is speaking live now delaware. christine o'donnell, who had the support from form area last can governor sarah palin, jim demint and the tea party express. but the national party, the republican senator -- senator campaign committee is not going to spend a dollar there. >> greta: bret, that you. president obama and democratic leadership are clear, they do not want to extend all the bush tax cuts not every democrat is in step. congressman jim hines. correct me if i'm wrong you unlike many democrats not all you believe that the tax cuts should be extended to everybody, including those who make more than $250,000 a year s that correct, sir? >> that's correct. the see if it over these upper end tax cuts on households making more thanuq.k $250,000. the larger point is those who look hard from an economic

standpoint don't feel comfortable raising any taxes at a point in time when the economy can best be described as recoverying very, very haltingly. people say with small businesses that you are only talking about 3% of the small businesses above $250,000. the fact is something like 40% of business income comes through at those tax returns that are in excess of $250,000. you don't want to right now, when this recovery is halting at best, put downward pressure on the recovery. to be clear, we can't extend these things permanently. until we are out of this thing, i think we need to be careful about imposing any downward pressure on the economy. >> greta: congressman, your republican challenger says this is a political decision. let me come to your defense. i did research, going back to january 26th, of this year you signed on a letter to president obama about in very issue. i take it you have been taking

it up with your party for sometime? >> that's right. of course the economics in january were even scarier than they are now. we hadn't seen the eight quarters of -- i'm sorry eight months of private sector job growth, wishful thinking, there, right, that we've seen since january. my opponent is saying and doing whatever he wants, distorting my record, the fact is, i have always considered this a moment in time when we need to be very careful about nurturing the economy in particular the small businesses and investment that would be hurt. we can argue about whether it would be hurt a lot or a little bit. there aren't many economists that say raising taxes on small businesses with that kind of income generating power would be good at this time. i've been consistent on that for a while. mob job is to represent people so i ask them what they think. the economics here are clear. >> greta: i defended you that your republican poe 0 -- there's one other thing worth

noting. do you have a rather wealthy constituency. you are from the connecticut area that has i think it is the 9th richest county in the country or something like that you are up there with the money. so you a lot of rich people in your district. >> we do. if this were about only pandering to people who are very, very wealthy even if my district which yes is affluent, the wealthy are still a relatively small percentage, including bridgeport, connecticut, cities that have a lot of poor people as is not a poor or rich issue out. we should never frame that it way this is what do we need to do temporarily, temporarily, to spur in economy along so that everybody does well? on the other side, people are saying truly ridiculous things. like i'm a fiscal conservative but i support tax cuts for everybody permanent that is fairy dust thinking that has no basis in reality a what we are arguing about is what we need to do now when the

reveiled he would continue this lawsuit if -- if he prevailed he would continue the lawsuit. rory reid senator reid's son, i don't think he is going to continue to the lawsuit. >> greta: what are the polls like? >> sandoval has a comfortable lead. >> greta: it is likely the republican governor will stay. will you be the one who will continue to prosecute this case? >> yes. >> greta: what is your biggest challenge? >> to get past in motion on a standing as well as the government's argument under the commerce clause it enjoys broad power therefore can enact this legislation the states have no bisque in court. i think the courts have to make a decision whether the power is as broad as the state i think. >> greta: if he expands it broadly the definition of the commerce clause you lose. if he has a narrow

interpretation you win? >> right. >> greta: the question is a question of whether or not not just anybody can bring a lawsuit, you got to have a real direct hurt. how does your standing look? what is your hurt? >> in nevada we've had to spend a lot of money hundreds of thousands implementing the act. hiring consultants putting administrative infrastructure. the figures is up over $300,000 now. by the end of 2018600 million dollars on this legislation. -- the cores have loud this kind of challenge before. >> greta: a judge can say you have a hurt so you can be here. i interpret the commerce clause broadly yes you can be here but yes you lose? >> right the court can say, -- we don't that i is going to be supported by precedent. >> greta: the government brought this motion to throw you out of court they go first

you respond and the judge will take it under advisement unless something freaky happens. >> we don't expect that. you know as a seasoned lawyer a judge in this case is going to issue a written decision. any idea when you can expect the decision? >> judge thinks it evers expedited treatment. he believes the country is interested and wants to have an expedited hearing and decision. >> greta: the next step is if you survive a motion to dismiss the next part is motion for summary judgment which is you go into court and say we don't need take testimony, we don't need evidence the law is what it is and we think we win. the federal government will say no. hear arguments from both sides and the judge will decide. >> this is going to be largely a legal question. whether the commerce clause and tax and spending clause reaches the outer limits that the federal government is arguing. we'll tee that up with the motion for summary judgment

and hopefully be successful there. >> greta: did you know it is not just states suing feds over the health care law? this is the federal courthouse where the hearing is today, there are 20 states attorney general plus your organization is argue . how do you work for? >> national federation of independent businesses, we represent small businesses and self-employed across the country. >> greta: there's the issue about standing mean who can participate and who can't who has a cause of action and been harmed. how does your organization claim its harm so you can be here? >> over 30,000 self-employed small business owners plus the hundreds of thousands that we have of small business owners. for the self-employed in particular the individual mandate is a double hit f you will, now they are forced to use discretionary dollars to buy health care to participate in a market, to enter a private contract whether they want to or not.

>> greta: any idea in terms of cost to your organization? >> -- >> greta: for your members. >> we've been hearing this for decades, they are seeing double digit premium increases. they are going up more in year as a result of this law. they are hearing the plans they've been buying that don't necessarily meet the congressionally level dictated -- level of dictated coverage are being discontinued now. they are already feeling the affects of this law on them. >> greta: everyone in the hearing today has a little different interests. is it possible that nfib can get bumped out of this and the states can continue on, you agree? >> i guess it is possible. but we feel very strong about our standing. again, our members are being harmed now. they are being affected by losing the health care coverage they currently have in addition they are seeing

dramatic premium increases as a result of the law. and having to plan to pay for something they may or may not want to purchase that they are not purchasing now and may not want to in the future. >> greta: you can be the own one in the lawsuit and the states can be bumped out if the judge don't believe they have standing. you could be the sole litigant on your side. >> that is possible too. we feel good about the standing of all the plaintiffs in this lawsuit. >> greta: any members within your organization who are complaining about the fact that nfib has brought in action? have you lost any members? >> i don't know that we've lost any. i do remember once we joined there were a few calls we received from members that were not happy. over -- the overwhelming vast majority have been complementry proud they are a member of organization that is stage up fighting for their freedoms of we've gotten positive response. >> greta: it is somewhat of an
